These terms and conditions apply to the ReceiveSMS app (hereby referred to as "Application") for mobile devices that was created by TurnaWorks (hereby referred to as "Service Provider") as a Freemium service.

Upon downloading or utilizing the Application, you are automatically agreeing to the following terms. It is strongly advised that you thoroughly read and understand these terms prior to using the Application.

Unauthorized copying, modification of the Application, any part of the Application, or our trademarks is strictly prohibited. Any attempts to extract the source code of the Application, translate the Application into other languages, or create derivative versions are not permitted. All trademarks, copyrights, database rights, and other intellectual property rights related to the Application remain the property of the Service Provider.

The Service Provider is dedicated to ensuring that the Application is as beneficial and efficient as possible. As such, they reserve the right to modify the Application or charge for their services at any time and for any reason. The Service Provider assures you that any charges for the Application or its services will be clearly communicated to you.

The Application stores and processes personal data that you have provided to the Service Provider in order to provide the Service. It is your responsibility to maintain the security of your phone and access to the Application. The Service Provider strongly advise against jailbreaking or rooting your phone, which involves removing software restrictions and limitations imposed by the official operating system of your device. Such actions could expose your phone to malware, viruses, malicious programs, compromise your phone's security features, and may result in the Application not functioning correctly or at all.

Please note that the Application utilizes third-party services that have their own Terms and Conditions. Below are the links to the Terms and Conditions of the third-party service providers used by the Application:

2. Account Obligations

By creating an account and using the Application, you agree to:

  • Provide accurate, current, and complete information during the registration process;
  • Maintain the confidentiality of your account credentials and not share them with third parties;
  • Be fully responsible for all activities that occur under your account;
  • Notify the Service Provider immediately at [email protected] of any unauthorized use of your account or any other security breach;
  • Not transfer, sell, or otherwise make your account available to any third party.

The Service Provider reserves the right to suspend or terminate your account if any information provided is found to be inaccurate, misleading, or if we detect suspicious activity.

3. Third-Party Trademarks Disclaimer

ReceiveSMS is an independent service and is not affiliated with, endorsed by, sponsored by, or associated with any third-party companies, brands, applications, platforms, or trademarks displayed within the app.

All product names, logos, brands, trademarks, and registered trademarks are the property of their respective owners. Their use within the app is strictly for identification, compatibility, and informational purposes only.

4. Service Scope and Limitations

4.1. ReceiveSMS provides a supplementary service that allows you to receive one-time verification SMS messages for account registration and login processes on online services.

4.2. The Service may not be used for emergency calls, disaster notifications, P2P messaging, bulk SMS sending, or continuous communication purposes.

4.3. Number allocation is temporary. After a specified period, the number is reclaimed and may be reallocated. The Service Provider is not responsible for messages not received before the expiry period, nor for any consequences arising from the use of the number by others after the period expires.

4.4. Operators, target platforms, or third parties may make technical or policy changes. Delivery success rate is not guaranteed.

4.5. The Service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. The Service Provider does not guarantee that the Service will be uninterrupted, timely, secure, or error-free.

5. Acceptable Use Policy (AUP)

The following activities are strictly prohibited. This list is illustrative and not exhaustive; all similar misuse is covered under this policy.

5.1 Illegal or High-Risk Use

  • Any illegal activity, or use contrary to public order and general morality.
  • Financial fraud, identity theft, account takeover (ATO), phishing, social engineering.
  • Money laundering (AML) violations, terrorist financing, transactions with sanctioned countries or individuals.
  • Illegal betting/gambling, drugs, weapons, fake documents, and similar criminal activities.
  • Child exploitation, sexual abuse, hate speech, and content inciting violence.

5.2 Use Contrary to Platform/Provider Rules

  • Registering or logging into target services (social networks, messaging apps, financial institutions, etc.) in violation of their Terms of Service.
  • Multi-accounting, ban evasion, bypassing age restrictions or geo-restrictions, impersonating real persons or entities.
  • Generating fake traffic or fake interactions using bots, automation, device farms, or emulators.
  • Manipulation of referral/bonus, campaign, or coupon systems; self-referral abuse.

5.3 Communication, Spam, and Abuse

  • Bulk or automated SMS sending, or using the Service as an SMS gateway.
  • Unsolicited messages, spam, fraudulent redirects, exploitation via link shortening networks.
  • Use in place of emergency call/disaster notification or critical communication infrastructure.

5.4 Privacy and Personal Data Violations

  • Unlawful processing, unauthorized sharing, or sale of third-party personal data.
  • Unauthorized profiling or tracking of device fingerprints, location, IP, cookies, or similar data.
  • Mass data scraping from target services, bypassing verification via screen capture or solver services.

5.5 Technical Abuse and Security Violations

  • Unauthorized access to the Service, sharing of session/identity credentials, vulnerability scanning, and penetration attempts.
  • Reverse engineering, source code extraction, bypassing encryption/DRM, API traffic manipulation.
  • Attacks that block or disrupt the Service, operators, or target services (DoS/DDoS, etc.).
  • Sale, resale, rental, or transfer of numbers or messages; brokerage activities.
  • Generating traffic intended to deceive security and risk controls using VPNs, proxies, rotating IPs, residential proxies, or similar tools.

5.6 Fair Use and Operational Limits

  • Excessive attempts or consecutive failed attempts within the defined session period or single-use scope.
  • Simultaneous use of the same number on different platforms or multi-session sharing.
  • Disproportionate API/request volume, automated queries, traffic patterns affecting service quality.

5.7 Sanctions and Enforcement

  • Upon detection of violations, the account may be suspended or terminated; related coins/balance may be partially or fully frozen.
  • Depending on the severity of the misuse, permanent blocking may be applied based on device, IP, or payment method.
  • In case of suspected criminal activity, a report will be made to judicial/administrative authorities; logs may be shared in accordance with applicable regulations.
  • Compensation for all damages arising from the violation may be claimed; legal action may be pursued.

5.8 Reporting and Cooperation

  • The user must report suspicious activity on their account to [email protected] without delay.
  • The Service Provider may cooperate with suppliers, operators, and target services for fraud prevention purposes.

6. Payments and Refunds

6.1. All payments for premium features and subscriptions are processed through the Apple App Store and Google Play Store. The Service Provider does not process payments directly.

6.2. By making a purchase, you agree to the terms and conditions of the respective app store platform. All transactions are subject to the refund policies of Apple and Google.

6.3. If you are unable to receive the service you paid for despite reasonable attempts, you may request a refund by contacting us at [email protected]. Refund requests will be evaluated on a case-by-case basis.

6.4. The Service Provider reserves the right to modify pricing for premium features and subscriptions at any time. Any price changes will be reflected on the paywall page within the Application. Existing active subscriptions will not be affected during their current billing period.

6.5. In the event of account termination due to a violation of these Terms, any remaining balance or unused credits may be forfeited at the sole discretion of the Service Provider.

7. Internet and Data Charges

Some functions of the Application require an active internet connection, which can be Wi-Fi or provided by your mobile network provider. The Service Provider cannot be held responsible if the Application does not function at full capacity due to lack of access to Wi-Fi or if you have exhausted your data allowance.

If you are using the application outside of a Wi-Fi area, please be aware that your mobile network provider's agreement terms still apply. Consequently, you may incur charges from your mobile provider for data usage during the connection to the application, or other third-party charges. By using the application, you accept responsibility for any such charges, including roaming data charges if you use the application outside of your home territory (i.e., region or country) without disabling data roaming. If you are not the bill payer for the device on which you are using the application, they assume that you have obtained permission from the bill payer.

8. Device Responsibility

The Service Provider cannot always assume responsibility for your usage of the application. For instance, it is your responsibility to ensure that your device remains charged. If your device runs out of battery and you are unable to access the Service, the Service Provider cannot be held responsible.

In terms of the Service Provider's responsibility for your use of the application, it is important to note that while they strive to ensure that it is updated and accurate at all times, they do rely on third parties to provide information to them so that they can make it available to you. The Service Provider accepts no liability for any loss, direct or indirect, that you experience as a result of relying entirely on this functionality of the application.

9. Limitation of Liability

To the maximum extent permitted by applicable law, the Service Provider shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, arising out of or in connection with your use of or inability to use the Service.

The Service Provider's total liability for any claims arising under these Terms shall not exceed the amount paid by you to the Service Provider (via in-app purchases) in the thirty (30) day period immediately preceding the event giving rise to the claim.

This limitation of liability applies whether the alleged liability is based on contract, tort, negligence, strict liability, or any other legal theory, even if the Service Provider has been advised of the possibility of such damages.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you. In such cases, the Service Provider's liability will be limited to the fullest extent permitted by applicable law.

10. Governing Law and Jurisdiction

These Terms and Conditions shall be governed by and construed in accordance with the laws of the Republic of Turkey, without regard to its conflict of law provisions.

Any legal action, suit, or proceeding arising out of or relating to these Terms, the Application, or the Service shall be brought exclusively in the courts located in Istanbul, Turkey. Each party irrevocably submits to the personal jurisdiction of such courts and waives any objection to the venue or inconvenient forum.

Notwithstanding the foregoing, the Service Provider may seek injunctive or other equitable relief in any court of competent jurisdiction to protect its intellectual property rights or confidential information.

11. User Responsibility & Cooperation with Authorities

Users are solely responsible for their activities conducted through the Service. The Service Provider acts only as a technology platform facilitating access to virtual phone numbers and does not monitor, control, or endorse user activities.

Users agree not to use the Service for any unlawful, fraudulent, abusive, or unauthorized purposes. The Service Provider reserves the right to suspend or terminate accounts involved in suspected violations.

The Service Provider may disclose relevant user information, including but not limited to account details, IP addresses, device information, transaction records, and usage logs, to law enforcement authorities, regulatory agencies, courts, or other authorized governmental bodies when required by applicable law, legal process, subpoena, court order, or other valid legal request, or where the Service Provider reasonably believes such disclosure is necessary to:

  • comply with applicable laws or legal obligations;
  • protect the rights, property, security, or safety of the Service Provider, users, or the public;
  • investigate, prevent, or address suspected illegal activities, fraud, abuse, or security incidents.

Where permitted by applicable law, the Service Provider may cooperate with authorities without prior notice to the user.

To the maximum extent permitted by applicable law, the Service Provider shall not be liable for disclosures made in good faith pursuant to this section.

12. Updates and Termination

The Service Provider may wish to update the application at some point. The application is currently available as per the requirements for the operating system (and for any additional systems they decide to extend the availability of the application to) may change, and you will need to download the updates if you want to continue using the application. The Service Provider does not guarantee that it will always update the application so that it is relevant to you and/or compatible with the particular operating system version installed on your device. However, you agree to always accept updates to the application when offered to you. The Service Provider may also wish to cease providing the application and may terminate its use at any time without providing termination notice to you. Unless they inform you otherwise, upon any termination, (a) the rights and licenses granted to you in these terms will end; (b) you must cease using the application, and (if necessary) delete it from your device.

13. Privacy, Personal Data and Log Retention

Your personal data is processed in accordance with our Privacy Policy. The Service Provider implements necessary administrative and technical measures to protect your information.

For the purposes of fraud prevention, security, and cooperation with judicial and administrative authorities, the Service Provider retains certain user activity logs, including but not limited to:

  • IP addresses and network information;
  • Device identifiers (such as UUID, IDFA, or equivalent);
  • Firebase User ID (optional) — a unique identifier assigned by Firebase for authentication and service functionality;
  • Email address (optional) — if you choose to provide it for account recovery or support purposes;
  • Precise timestamps of access, transactions, and usage;
  • Payment metadata and transaction records;
  • Account activity logs and usage patterns.

Such data is retained in accordance with applicable data protection laws and may be disclosed to law enforcement, regulatory agencies, or courts when required by a valid legal request, or when the Service Provider reasonably believes disclosure is necessary to investigate, prevent, or address illegal activities, fraud, or security incidents.

Certain operations within the Application may be monitored through risk scoring, device fingerprinting, IP logging, and transaction logs for the purpose of preventing abuse and ensuring the security of the Service.

14. Age Restriction

This Application does not target anyone under 18 years of age. The Service Provider does not knowingly solicit data from or market to individuals under the age of 18. If you are under 18, you are not permitted to use this Application. If the Service Provider becomes aware that a person under 18 has provided personal information, steps will be taken to remove such information and terminate the account.

15. Indemnification

You agree to indemnify, defend, and hold harmless the Service Provider and its affiliates, officers, agents, and employees from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney fees) arising out of or related to:

  • Your use of the Service in violation of these Terms;
  • Your violation of any third-party rights, including but not limited to intellectual property rights or privacy rights;
  • Any illegal, fraudulent, or harmful activity conducted by you through the Service.

16. Service Changes and Maintenance

The Service Provider reserves the right to modify, suspend, or discontinue the Service (or any part thereof) temporarily or permanently, with or without notice. Planned maintenance windows will be announced where reasonably possible. The Service Provider shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

17. Notice and Takedown Procedure

Target platforms, third-party service providers, or any affected parties may report suspected abuse or misuse of the Service (including but not limited to the use of virtual numbers to violate platform terms of service, bypass security measures, or engage in fraudulent activities) by submitting a written notice to [email protected].

Valid abuse reports should include:

  • The specific phone number(s) involved in the alleged abuse;
  • A clear description of the alleged violation or misuse;
  • Supporting evidence (such as timestamps, screenshots, or logs);
  • Contact information of the reporting party.

Upon receipt of a valid abuse report, the Service Provider will review the matter promptly. The Service Provider reserves the right to immediately suspend, terminate, or block access to the involved numbers, accounts, or IP addresses without prior notice to the user, at its sole discretion.

The Service Provider may also report confirmed illegal activities to relevant judicial or administrative authorities and cooperate fully with any investigations.

18. Changes to These Terms and Conditions

The Service Provider may periodically update their Terms and Conditions. Therefore, you are advised to review this page regularly for any changes. The Service Provider will notify you of any changes by posting the new Terms and Conditions on this page.
